1. Introduction

Welcome to Curated by Ticha.

These Terms & Conditions ("Terms") govern the use of this website and the independent travel planning services provided by Curated by Ticha ("Curated by Ticha").

By using this website, submitting an enquiry, booking a Planning Consultation, purchasing a travel planning experience, or otherwise engaging with our Services, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you should not use our Services.

These Terms should be read together with our Privacy Policy and Cookie Policy, which explain how Curated by Ticha collects, uses, and protects your personal information.

2. About Curated by Ticha

Curated by Ticha provides independent, bespoke travel planning services for clients seeking professionally researched and carefully curated travel experiences.

Curated by Ticha is not a travel agency, tour operator, travel provider, booking agent, or travel management company.

Unless expressly agreed in writing, Curated by Ticha does not make bookings or reservations on behalf of Clients, issue travel tickets, collect payments for third-party travel services, or act as an agent or representative of hotels, airlines, cruise lines, tour operators, destination management companies, or any other travel suppliers.

Our Services are limited to providing personalised travel planning, destination research, hotel recommendations, itinerary design, and related planning services based on the information provided by the Client.

Any agreement for accommodation, flights, transportation, cruises, activities, insurance, visas, or any other travel-related service is entered into directly between the Client and the relevant third-party supplier. Curated by Ticha is not a party to those agreements and cannot be held responsible for the acts, omissions, availability, pricing, policies, insolvency, or performance of any third-party supplier.

3. Scope of Services

Curated by Ticha provides bespoke travel planning services tailored to the Client's individual requirements, preferences, and travel objectives.

Depending on the Service purchased, this may include:

destination research and recommendations;
hotel and accommodation recommendations;
itinerary design and travel planning;
transportation recommendations;
restaurant, experience, and activity recommendations;
practical travel guidance relevant to the planned itinerary; and
other planning services expressly agreed between Curated by Ticha and the Client.

The exact scope of each Service is described on this website or otherwise confirmed in writing before work begins.

Curated by Ticha will use reasonable skill, care, professional judgement, and experience in preparing recommendations and planning materials. However, all recommendations are based on the information provided by the Client and the availability of travel services at the time the recommendations are prepared.

Unless expressly stated otherwise in writing, our Services do not include:

making or managing travel bookings;
processing payments to third-party suppliers;
obtaining passports, visas, travel permits, or travel insurance;
providing legal, immigration, tax, financial, or medical advice;
guaranteeing the availability, price, quality, suitability, or performance of any third-party travel service; or
providing ongoing travel support after the agreed Services have been completed.

Curated by Ticha may, acting reasonably and in good faith, agree to undertake additional work outside the agreed scope, which may be subject to additional fees.

Submission of an enquiry or request for Services does not create a contractual relationship between the Client and Curated by Ticha. A contract is formed only when Curated by Ticha confirms acceptance of the requested Service and any applicable payment requirements have been satisfied.

4. Planning Consultation

A Planning Consultation is a standalone professional service designed to help the Client determine the most appropriate level of travel planning support for their proposed trip.

The Planning Consultation is a separate service and is not included within any travel planning experience offered by Curated by Ticha.

The consultation fee covers the time, expertise, professional judgement, and personalised advice provided during the consultation itself, regardless of whether the Client subsequently purchases any additional Services.

Following the consultation, Curated by Ticha may recommend one of its travel planning experiences, advise that a different level of planning support would be more appropriate, or conclude that our Services are not the right fit for the Client's requirements.

The consultation fee is credited towards a qualifying travel planning experience if booked within the period specified on the Curated by Ticha website at the time of booking. If no qualifying Service is purchased within that period, the consultation fee remains non-refundable.

Once a Planning Consultation has taken place, the Service is deemed to have been fully performed and no refund will be available on the basis that the Client disagrees with, does not wish to follow, or is dissatisfied with the professional recommendations provided.

Planning Consultation Bookings

Planning Consultations may be rescheduled or cancelled without charge provided that the Client gives at least 24 hours' notice before the scheduled appointment.

Where less than 24 hours' notice is provided, or where the Client fails to attend the scheduled consultation without prior notice, the consultation shall be treated as a late cancellation or no-show, the consultation fee shall remain payable, and no refund will be available.

If the Client arrives more than 15 minutes late, Curated by Ticha reserves the right, acting reasonably and in good faith, either to proceed with the remaining consultation time or to treat the appointment as a no-show.

If Curated by Ticha is unable to conduct the consultation as scheduled, the Client will be offered an alternative appointment at the earliest reasonably available opportunity. If a suitable alternative cannot be agreed, the Client may choose to receive a full refund of the consultation fee.

Where the consultation cannot proceed due to technical difficulties beyond the reasonable control of either party, the consultation will be rescheduled for a mutually convenient time at no additional cost.

5. Travel Planning Experiences

Travel planning experiences provided by Curated by Ticha are bespoke professional services created specifically for each Client.

Due to the personalised nature of the Services, each travel planning experience is individually researched and prepared based on the Client's requirements, preferences, travel objectives, and any other information provided during the planning process.

Curated by Ticha will use reasonable skill, care, professional judgement, and experience in preparing recommendations and planning materials. Recommendations reflect our professional opinion based on the information available at the time they are prepared and should not be interpreted as guarantees or assurances regarding any destination, accommodation, transport provider, experience, or other travel service.

The Client acknowledges that all recommendations remain subject to availability, price changes, supplier policies, operational changes, and other circumstances beyond the control of Curated by Ticha.

Unless expressly agreed otherwise in writing, a travel planning experience is considered fulfilled once the agreed planning materials, recommendations, itinerary, or other deliverables have been provided to the Client.

Delivery of Services

Unless otherwise agreed in writing, the Services shall be deemed delivered when the agreed planning materials have been sent to the email address provided by the Client or otherwise made available to the Client by an agreed method of delivery.

Curated by Ticha shall not be responsible for any delay or failure in delivery resulting from an incorrect email address provided by the Client, the Client's email settings, spam filtering, mailbox capacity, internet connectivity, or any other circumstance beyond the reasonable control of Curated by Ticha.

The Client is responsible for checking their inbox, spam or junk folders, and contacting Curated by Ticha within a reasonable time if the agreed materials have not been received.

Due to the bespoke and personalised nature of the Services, refunds will not be available solely because the Client changes their mind, decides not to travel, chooses not to follow the recommendations provided, or is dissatisfied with the subjective nature of those recommendations once the Services have been completed and the agreed deliverables have been supplied.

Any request which falls outside the agreed scope of the purchased Service, including substantial revisions, additional destinations, additional research, or significant changes to the original travel brief, may be treated as additional work and may be subject to additional fees.

6. Fees & Payment

The fees for all Services are those published on the Curated by Ticha website or otherwise confirmed in writing before the Client purchases the Service.

Payment must be made in full before Curated by Ticha commences any planning work, research, preparation of personalised travel materials, or provides any recommendations, unless otherwise agreed in writing.

The Client is responsible for ensuring that all payment details provided are accurate and that sufficient funds are available to complete the transaction.

Fees paid to Curated by Ticha relate solely to the professional travel planning Services provided and do not include the cost of accommodation, flights, transport, insurance, visas, activities, taxes, supplier charges, or any other third-party travel expenses unless expressly stated otherwise.

The Client is solely responsible for paying all third-party suppliers directly and in accordance with their respective payment terms and conditions.

Curated by Ticha reserves the right to refuse to commence or continue providing the Services if payment has not been received in accordance with these Terms.

Curated by Ticha reserves the right to amend its fees from time to time. Any revised fees shall apply only to Services purchased after the revised fees have been published or otherwise confirmed in writing and shall not affect Services already purchased by the Client.

7. Client Responsibilities

The Client is responsible for providing accurate, complete, and up-to-date information necessary for Curated by Ticha to perform the Services.

This includes, where relevant, travel dates, destinations, budget, travel preferences, accommodation requirements, accessibility needs, dietary requirements, visa status, passport validity, and any other information which may reasonably affect the planning process.

The Client is responsible for reviewing all recommendations, itineraries, and planning materials provided by Curated by Ticha and for ensuring that all bookings, travel dates, passenger names, destinations, and other travel details are correct before making any reservation or payment with a third-party supplier.

The Client acknowledges that all decisions relating to the selection, booking, purchase, or use of any third-party travel service are made solely by the Client.

Curated by Ticha shall not be responsible for any loss, cost, delay, inconvenience, or other consequence arising from:

inaccurate, incomplete, or outdated information supplied by the Client;
the Client's failure to review recommendations or travel details before booking;
the Client's decision to modify, disregard, or only partially follow the recommendations provided;
bookings made independently by the Client which differ from the recommendations prepared by Curated by Ticha.

The Client remains responsible for ensuring that they hold all necessary travel documentation, including valid passports, visas, insurance, vaccinations where applicable, and any other documentation required by the relevant authorities or travel suppliers.

The Client acknowledges that the timely provision of the Services depends upon their cooperation throughout the planning process. Any delay in providing requested information, documents, decisions, approvals, or feedback may result in a corresponding delay in the provision of the Services. Curated by Ticha shall not be responsible for any delay arising from the Client's failure to respond or provide the requested information within a reasonable time.

8. Bookings & Third-Party Suppliers

Curated by Ticha provides independent travel planning services only and does not sell, arrange, or supply travel products or travel services.

Unless expressly agreed otherwise in writing, all bookings for accommodation, flights, transportation, cruises, activities, restaurants, insurance, and any other travel services are made directly by the Client with the relevant third-party supplier.

The Client enters into a separate contract with each third-party supplier and is solely responsible for reviewing and accepting that supplier's terms and conditions, payment policies, cancellation policies, and any other applicable contractual terms before making a booking.

Curated by Ticha is not a party to any agreement between the Client and a third-party supplier and cannot amend, enforce, or accept responsibility for those agreements.

Curated by Ticha cannot guarantee the continued availability, pricing, suitability, quality, safety, or performance of any third-party travel service recommended to the Client.

Recommendations are based on information reasonably available at the time they are prepared. Availability, prices, schedules, services, facilities, and supplier policies may change at any time without notice and are outside the control of Curated by Ticha.

Curated by Ticha shall not be liable for any act, omission, error, cancellation, delay, overbooking, schedule change, insolvency, service failure, or other action or inaction of any third-party supplier.

Any complaint, claim, request for compensation, refund, or dispute arising from or relating to a third-party travel service must be addressed directly to the relevant supplier.

9. Changes, Cancellations & Additional Work

Due to the bespoke nature of the Services, the Client acknowledges that work may commence immediately after payment has been received.

Once work has commenced, Curated by Ticha may have already invested substantial time in research, planning, analysis, and preparation of personalised recommendations.

If the Client requests significant changes to the original travel brief after work has commenced, including but not limited to changes of destination, travel dates, budget, travel style, number of travellers, or overall travel objectives, Curated by Ticha reserves the right, acting reasonably and in good faith:

continue the work as originally agreed;
agree to revise the scope of the Services; or
treat the request as additional work subject to additional fees.

Curated by Ticha is under no obligation to accept requests which fundamentally alter the original scope of the Services.

Minor amendments which remain within the original agreed travel brief may be accommodated at the discretion of Curated by Ticha where reasonably practicable.

Requests that materially alter the original travel brief, including changes to the destination, travel dates, budget, travel style, number of travellers, or overall travel objectives, may constitute additional work and may be subject to additional fees.

Curated by Ticha shall determine, acting reasonably and in good faith, whether a requested amendment falls within the original scope of the Services or constitutes additional work.

If the Client chooses to cancel the Services after work has commenced, the Client acknowledges that Curated by Ticha is entitled to retain all fees paid to reflect the professional time, expertise, research, and work already undertaken.

Where the agreed planning materials have already been delivered to the Client, the Services shall be considered fully performed and no refund shall be due, except where required by applicable law.

10. Limitation of Liability

Curated by Ticha will exercise reasonable skill, care, and professional judgement in providing the Services.

However, the Client acknowledges that travel involves circumstances beyond the control of Curated by Ticha and that recommendations are based upon information reasonably available at the time they are prepared.

To the fullest extent permitted by applicable law, Curated by Ticha shall not be liable for any loss, damage, expense, delay, disappointment, inconvenience, injury, or additional cost arising directly or indirectly from:

the acts or omissions of any third-party supplier;
cancellations, delays, schedule changes, overbooking, insolvency, or service failures of any third-party supplier;
changes in prices, availability, facilities, services, or operating conditions after recommendations have been provided;
decisions made by the Client before, during, or after their travel;
inaccurate, incomplete, or misleading information supplied by the Client;
the Client's failure to review or verify travel details before making bookings;
weather conditions, natural disasters, epidemics, pandemics, industrial action, government restrictions, political events, security incidents, or any other event outside the reasonable control of Curated by Ticha;
any action taken by immigration authorities, border agencies, customs authorities, or other governmental bodies.

Curated by Ticha does not guarantee that any recommendation will remain available in the future, represent the lowest available price, satisfy the Client's personal preferences, or produce any particular travel outcome.

Nothing in these Terms excludes or limits any liability which cannot legally be excluded or limited under applicable law.

11. Intellectual Property

All itineraries, travel proposals, recommendations, planning materials, documents, guides, checklists, PDFs, written content, and any other materials prepared by Curated by Ticha remain the intellectual property of Curated by Ticha unless otherwise required by applicable law.

Upon receipt of full payment, the Client receives a personal, non-exclusive, non-transferable licence to use the planning materials solely for their own personal travel purposes.

The Client may share the planning materials with fellow travellers included in the same trip solely for the purpose of that trip. The materials must not otherwise be copied, reproduced, distributed, published, sold, licensed, modified, commercially exploited, or made available to any other third party without the prior written consent of Curated by Ticha.

The Client must not use the planning materials for any commercial purpose or permit any third party to rely upon, reproduce, or use those materials.

Curated by Ticha retains all intellectual property rights, copyright, know-how, methodologies, research processes, planning techniques, templates, and other proprietary materials developed or used in providing the Services.

Nothing in these Terms transfers ownership of any intellectual property rights from Curated by Ticha to the Client.

12. Privacy & Data Protection

Curated by Ticha processes personal information in accordance with its Privacy Policy, which forms an important part of these Terms.

By using our Services, the Client acknowledges that certain personal information is required in order for Curated by Ticha to provide the Services.

The Client confirms that all personal information provided is accurate and that they have the authority to provide any personal information relating to other travellers included within the travel planning request.

Curated by Ticha will process personal information only for legitimate business purposes connected with providing the Services, complying with legal obligations, communicating with the Client, and any other purpose described in the Privacy Policy.

13. Force Majeure

Curated by Ticha shall not be liable for any failure or delay in performing the Services where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include, but are not limited to:

natural disasters;
severe weather conditions;
fire, flood, earthquake, or other environmental events;
war, terrorism, civil unrest, or political instability;
epidemics, pandemics, or public health emergencies;
industrial action, strikes, or lockouts;
interruptions to communication networks, internet services, or essential technology;
government action, sanctions, restrictions, or changes in applicable law; and
any other event beyond the reasonable control of Curated by Ticha.

Where reasonably possible, Curated by Ticha will make reasonable efforts to communicate with the Client and resume the Services as soon as circumstances permit.

Nothing in this clause affects any rights which cannot legally be excluded under applicable law.

Where a Force Majeure event prevents Curated by Ticha from performing the Services for an extended period, Curated by Ticha shall be entitled to suspend the Services until performance becomes reasonably possible.

14. General Provisions

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms or the Services provided by Curated by Ticha shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable law requires otherwise.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

No failure or delay by Curated by Ticha in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.

Curated by Ticha reserves the right to amend these Terms from time to time. Any revised version will apply to Services purchased after the revised Terms have been published on the Curated by Ticha website and will not affect Services already purchased unless otherwise agreed.

These Terms, together with the Privacy Policy and any written confirmation of the Services provided by Curated by Ticha, constitute the entire agreement between the parties relating to the Services and supersede all prior discussions, correspondence, representations, negotiations, and understandings, whether written or oral, relating to the same subject matter.

Any amendment to the agreed Services or any variation of these Terms shall only be binding if confirmed by Curated by Ticha in writing by email. Communications through social media platforms, messaging applications, or other informal channels shall not, by themselves, amend these Terms or the agreed scope of the Services.

The Client may not assign, transfer, or otherwise dispose of any rights or obligations under these Terms without the prior written consent of Curated by Ticha.
